BlockBeats 消息，2 月 13 日，中国上海市静安区人民法院日前审理了一起投资虚拟货币引发的不当得利纠纷案。吴女士被直播间主播诱导投入 105 万元参与虚拟货币交易，遭遇平台无法提现后诉至法院求偿，但其诉求在一审、二审均被驳回，最终需自行承担全部损失。这起终审判决，也为所有心存侥幸、盲目投身虚拟货币炒作的投资者敲响了警钟。
2019 年 11 月，吴女士接到推销电话，并在直播间投资理财主播的引导下，下载了一款虚拟货币交易软件。通过该交易平台，吴女士先后投入 105 万元，与 8 名卖家达成交易，其中与何先生的交易金额为 8 万元。后来吴女士发现该款交易软件无法登录，吴女士在该平台账户内价值 105 万元的虚拟货币无法提现。
2024 年，吴女士向当地公安机关报案的同时，以不当得利为由向法院提起民事诉讼，要求何先生返还交易金额 8 万元。但何先生辩称，其系某数字交易所会员，挂单售卖数字货币 USDT，未注册过吴女士所称的平台账户，且钱款到账后双方已完成了交易，不存在不当得利情形。
上海市静安区人民法院审理后认为，根据《中华人民共和国民法典》相关规定，民事主体从事民事活动，不得违反法律，不得违背公序良俗。本案中，案涉的 USDT 是一种虚拟货币，虚拟货币不具有与法定货币等同的法律地位，虚拟货币的相关业务活动属于非法金融活动。**吴女士从事的投资交易属于虚拟货币相关业务活动，交易虚拟货币的行为破坏了国家的金融监管秩序，违反了公序良俗，属于无效的民事法律行为，由此引发的损失应由其自行承担。**综上，静安区人民法院驳回原告吴女士的全部诉请。吴女士对该判决不服，提出上诉。二审法院经审理后判决驳回上诉，维持原判。
